Terms of Service

Charleston Creative Media - Terms of Service

Effective Date: October 17, 2025

These Terms of Service ("Terms") govern all services provided by Charleston Creative Media ("Photographer" or "We") to the client ("Client" or "You"), including all real estate photography, videography, 3D tours, floor plans, and digital media services ("Services"). By booking a Service, you agree to these Terms.

1. Licensing and Copyright

1.1. Copyright Ownership: Charleston Creative Media retains the sole and exclusive copyright ownership of all images, videos, 3D models, and media created during the provision of the Services.

1.2. Grant of License: We grant the Client a non-exclusive, non-transferable, non sub-licensable license to use the media for the sole purpose of marketing the specific property associated with the shoot, for the duration the listing is active on the MLS.

1.3. Usage Rights:

  • This license permits use on the MLS, brokerage website, agent's personal website, social media, and printed flyers for the property listing.

  • The license is revoked immediately upon the expiration, cancellation, or sale of the specific property listing.

  • The license is granted only to the hiring Client/Agent. Media may not be resold, transferred, or provided to third parties (including builders, architects, stagers, or subsequent listing agents) without express written permission and a separate licensing agreement from Charleston Creative Media.

1.4. Commercial Use Restrictions: Any use beyond marketing the specific real estate listing (e.g., promotional materials for the Agent/Brokerage's brand, training, or portfolio) must be specifically licensed and agreed upon in writing.

2. Scheduling, Cancellation, and Fees

2.1. Scheduling: All bookings must be made through our designated booking platform or confirmed via email. We operate within the Charleston Tri-County area.

2.2. Cancellation/Reschedule Policy: If the Client cancels or reschedules a booking:

  • More than 24 hours notice: No penalty.

  • Less than 24 hours notice: A cancellation fee of $75 will be charged.

  • Arrival and Property Not Ready: If the Photographer arrives and the property is not ready for shooting (e.g., staging is incomplete, utilities are off, significant clutter), the shoot will be treated as a cancellation with less than 24 hours notice, and the full cancellation fee will apply.

2.3. Weather Policy (Drone/Twilight): The Photographer reserves the right to reschedule drone photography or twilight shoots due to inclement weather (e.g., heavy rain, high winds, poor visibility). There is no cancellation fee for weather-related reschedules.

3. Payment and Delivery

3.1. Payment Terms: Full payment is due prior to image download. Final media will not be released until payment is received in full.

3.2. Delivery: Media will be delivered digitally via our online client gallery system (Pixieset). Delivery of standard photography is guaranteed within 48 hours (typically 24 hours). 3D tours, floor plans, and specialty editing may require up to 48 hours.

3.3. Property Preparation: The Client is responsible for ensuring the property is completely ready (cleaned, decluttered, staged, and all lights/fixtures working) prior to the Photographer’s arrival. The Photographer will not spend more than 10 minutes staging or cleaning.

4. Limitation of Liability

The Photographer’s entire liability for any claim, breach of contract, or negligence arising from this agreement shall be limited to the total amount paid by the Client for the specific Service in question. Charleston Creative Media shall not be liable for any indirect, incidental, or consequential damages.

By booking a Service with Charleston Creative Media, you acknowledge that you have read, understood, and agree to these Terms of Service.
